Calling a recent U.S. Supreme Court ruling a “straightforward path” to a legal victory, lawyers for the state of Illinois said Friday they hope to quickly resolving ongoing litigation

Gov. Henry McMaster and National Guard Maj. Gen. Robin Stilwell were named in the lawsuit filed by a Navy veteran and public interest group.

Courts blocked troops from deploying in Chicago and Portland, Ore., and the Los Angeles deployment effectively ended after a judge blocked it earlier this month.

Navy veteran James Weninger and the South Carolina Public Interest Foundation’s lawsuit, filed in the SC Supreme Court, argues that the governor’s deployment violates South Carolina law, which only allows the Guard to be called up under conditions set by the South Carolina General Assembly.

A South Carolina nonprofit and Navy veteran argued deploying the state’s National Guard is illegal under state law, according to court documents filed Wednesday.

The order arrived nearly a week after President Donald Trump announced on social media that he would abandon his push to deploy troops to three cities, including Portland.

That gives the White House far greater authority in the capital than anywhere else in the country. The president also moved to assert control over the D.C. police, citing emergency powers under the Home Rule Act.
